1. Acceptance of Terms

By accessing or using Producer.Directory ("the Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Platform. These Terms apply to all users, including licensed insurance agents, brokers, and agency administrators.

2. Eligibility and Account Requirements

To use Producer.Directory, you must:

  • Be a licensed insurance producer in good standing in at least one U.S. state
  • Provide accurate and complete registration information
  • Maintain active insurance licenses throughout your use of the Platform
  • Comply with all applicable federal and state insurance regulations
  • Be at least 18 years of age

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must immediately notify us of any unauthorized use of your account.

3. Zero-Knowledge Proof Architecture

Producer.Directory employs zero-knowledge proof cryptography to protect user and client data. This means:

  • We cannot access your clients' personal information
  • Personal contact data is released only through verified phone consent
  • You cannot store client information without explicit, documented consent
  • All data transmission is encrypted and anonymized

By using the Platform, you acknowledge that these privacy protections are foundational to the system architecture and cannot be circumvented.

4. Credit System and Lead Bidding

Producer.Directory operates on a performance-based credit system. Credits are earned through:

  • Call quality metrics (duration, engagement, response time)
  • Professional qualifications (licenses, carrier appointments, certifications)
  • Closing performance (conversion rates, policy retention)
  • Compliance history (regulatory adherence, renewal timeliness)

Credits are non-transferable and may not be purchased with cash. The Platform reserves the right to adjust credit values and bidding algorithms to maintain fair access and quality standards.

5. Compliance Obligations

You agree to:

  • Maintain all required insurance licenses in states where you conduct business
  • Comply with TCPA, GDPR, CCPA, and all applicable privacy regulations
  • Obtain proper consent before storing or using client information
  • Report any compliance violations or suspicious activity immediately
  • Submit to periodic verification of licensing and appointment status

Failure to maintain compliance may result in account suspension or termination without refund.

6. Phone Service Partnership

Producer.Directory partners with third-party phone service providers to facilitate compliant communication between agents and leads. By using the Platform's phone features:

  • You consent to call recording for quality assurance and compliance verification
  • You acknowledge that contact information is released only through verified consent
  • You agree to use partnered phone systems for all initial lead contact
  • Phone credits are separate from lead bidding credits and subject to partner terms

7. Intellectual Property

All content, features, functionality, and technology on the Platform are owned by Producer.Directory and are protected by intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Platform without express written permission.

8. Limitation of Liability

Producer.Directory provides tools and infrastructure but does not guarantee business outcomes. We are not responsible for:

  • Lost revenue or business opportunities
  • Quality or accuracy of leads provided through the Platform
  • Actions of other users on the Platform
  • Third-party integrations or partner services

9. Termination

We reserve the right to suspend or terminate your account at any time for violations of these Terms, loss of required licenses, compliance violations, or fraudulent activity. Upon termination, your access to the Platform and any unused credits will be forfeited.

10. Changes to Terms

We may modify these Terms at any time. Material changes will be communicated via email and in-app notification at least 30 days before taking effect. Continued use of the Platform after changes constitutes acceptance of modified Terms.
